Terms of Service

These Terms form a binding agreement between you ("User") and Chasing Pelagics LLC, a California limited liability company ("Catalysst", "we", "us"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

"Service" means the Catalysst SoCal product, websites, apps, APIs, data pipelines, documentation, branding, and any related products operated by Chasing Pelagics LLC, including domains socal.catalysst.net, app.chasingpelagics.com, reports.chasingpelagics.com, and flights.chasingpelagics.com.

2. Eligibility & Accounts

• You must be at least 18 years old and legally able to enter a binding contract.
• Accounts are issued to individual humans. You may not share, resell, transfer, or permit others to use your credentials.
• You are responsible for the confidentiality of your credentials and all activity under your account.
• We may suspend or terminate accounts for violation of these Terms, abusive access patterns, credential sharing, chargebacks, fraud, or any activity we reasonably deem harmful to the Service or other users.

3. Subscription, Billing & Trials

• The Service is offered on recurring monthly subscriptions.
• A 7-day free trial may be offered on new subscriptions. A valid payment method is required at signup. At the end of the trial, your subscription will automatically renew at the published price unless you cancel before the trial ends.
• Subscriptions renew automatically each billing period until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period.
• No refunds. Fees already paid are non-refundable except where required by law. We do not pro-rate partial months.
• Prices are in U.S. dollars, exclusive of applicable taxes.
• We may change prices with at least 30 days' notice by email.

4. Acceptable Use

You agree not to, and not to permit any third party to:

• copy, decompile, reverse-engineer, disassemble, or attempt to derive the source code of the Service beyond what is expressly permitted by applicable law;
• scrape, crawl, harvest, mirror, or otherwise extract data from the Service by automated means except via officially documented API within the rate limits of your subscription;
• resell, sublicense, republish, broadcast, or commercially redistribute any data, imagery, vessel positions, map tiles, oceanographic layers, Areas of Interest, reports, analytics, or other Service content;
• use the Service to train machine-learning models or to build a competing product;
• circumvent rate limits, authentication, access controls, geographic restrictions, DRM, or Cloudflare/WAF protections;
• share, transfer, or sell your credentials, or allow multiple people to use a single subscription;
• test, scan, or probe the Service for vulnerabilities without prior written consent;
• use the Service to violate law or any third-party right, or to harass, defraud, or harm others;
• use the Service for navigation, collision avoidance, search and rescue, or any safety-critical purpose.

5. Intellectual Property

All software, source code, designs, user interfaces, content, trade marks, branding (including the CATALYSST word mark and logo), data pipelines, processed datasets, analytics, and derivative works displayed through the Service are the exclusive property of Chasing Pelagics LLC or its licensors, protected by U.S. and international copyright, trade secret, and trade mark law. No license is granted except as strictly necessary to operate the Service within its intended user interface while your subscription is active.

6. Third-Party Data Sources

The Service aggregates data from third-party sources (NOAA, NASA, AISStream.io, Kpler/MarineTraffic, OpenSky Network, adsb.lol, and others). We make no warranty that such data is accurate, timely, complete, or fit for any purpose. Use is subject to each source's own terms.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, TIMELINESS, AND UNINTERRUPTED OPERATION.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CHASING PELAGICS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, VESSEL, EQUIPMENT, CATCH, LIFE, OR LIMB, ARISING OUT OF USE OR INABILITY TO USE THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

9. Indemnification

You agree to defend, indemnify, and hold harmless Chasing Pelagics LLC from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or breach of these Terms.

10. DMCA & Copyright Notices

11. Termination

You may terminate your account at any time. We may suspend or terminate your access immediately, without notice and without refund, for any violation of these Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, USA. Any dispute shall be resolved exclusively in the state or federal courts of San Diego County, California. You waive any right to participate in a class action or class arbitration to the fullest extent permitted by law.

13. Changes

We may update these Terms at any time. Material changes will be notified by email or in-app notice at least 30 days before taking effect. Continued use after changes constitutes acceptance.
